Privacy policy

Modaks ("we", "us") sells baking ingredients online at modaks.co.za, under the Modaks, J.A.M. Foods and Chef Ali brands. We respect your privacy and handle your personal information in line with the Protection of Personal Information Act, 2013 (POPIA). This policy explains what we collect, why, who we share it with and what rights you have.

Who is responsible for your information

Modaks, Fish River Street, Lenasia, Johannesburg. Email info@jamfoods.co.za or call 011 857 1534. Send any privacy request to that email address and mark it "Privacy".

What we collect

• When you order: your name, email address, phone number, delivery and billing address, and the items you order.
• When you create an account: your email address, name and password (stored securely, we cannot read it), plus your order history.
• When you contact us or join our newsletter: your name, email address and the message you send.
• When you visit the site: technical information such as your browser, device, pages viewed and approximate location, collected through cookies. See our cookie policy.

We do not collect or store your card details. Card payments are handled by our payment provider.

Why we use your information

• To process and deliver your order, and to tell you about its progress.
• To take payment and prevent fraud.
• To look after your account and answer your questions.
• To remind you about a cart you left behind, by email, if you gave us your email address at checkout. You can opt out in any of those emails.
• To send our newsletter, only if you signed up. Every email has an unsubscribe link.
• To understand how the site is used and improve it, and, only if you accept cookies, to measure and improve our advertising.
• To meet legal duties, such as tax and accounting records.

Who we share it with

We share only what is needed, with the services that help us run the shop:

• Payment providers: Peach Payments (card and instant payments) and, if you choose EFT, our bank details are given to you for the transfer.
• Couriers and delivery partners: your name, address and phone number, so they can deliver.
• Website, hosting and email services: our hosting provider and the services that send our order and newsletter emails.
• Analytics and advertising: Google (Analytics, Merchant Center and Ads) and Meta (Facebook and Instagram), but only if you accept cookies.

Some of these providers are based outside South Africa. When that happens we rely on providers that protect personal information to a standard comparable to POPIA. We never sell your personal information.

How long we keep it

We keep order and invoice records for as long as the law requires, normally five years. Account details are kept while your account is open. Newsletter details are kept until you unsubscribe. You can ask us to delete your account at any time.

How we protect it

The site runs over a secure (HTTPS) connection, access to customer information is limited to the people who need it, and we keep our software up to date. No system is perfectly secure. If a breach affects your information we will tell you and the Information Regulator as the law requires.

Your rights

Under POPIA you may ask us to tell you what personal information we hold about you, to correct it, or to delete it. You may object to us using it for marketing and may withdraw your consent at any time. Email us at the address above and we will respond within a reasonable time.

If you are unhappy with how we handle your information you can complain to the Information Regulator (South Africa): inforegulator.org.za, complaints.IR@justice.gov.za.

Children

Our shop is meant for adults. We do not knowingly collect information from children under 18. If you believe a child has given us information, please tell us and we will delete it.

Changes to this policy

If we change this policy we will update the date at the top of this page.
